  1. GENERAL
    • BLAK SAND, (Trade name: M/S. TIRUBALA INTERNATIONAL PRIVATE LIMITED) having its registered addressed C-7, Panki Industrial Area, Site 1, Kanpur, Uttar Pradesh, India 208022 (“BLAK SAND”, “we”, “us” or “our”) is managing and operating the website https://www.blaksand.com, (collectively  referred to as the “BLAK SAND Platform”), through which it inter alia facilitates the sale of footwear and  other products under the brand name “BLAK SAND” (“Products”) to the users of the BLAK SAND Platform (“User” or “Users” or “you” or “your”).
    • This delivery and shipping policy (“Policy”), together with the Terms (accessible here: [https://www.blaksand.com/in/terms-and-conditions]) sets out our policies and procedures towards delivery and shipping of Products purchased on the BLAK SAND Platform.
    • We offer shipping and delivery services across India and to most countries worldwide. To provide you with the best customer experience, we collaborate with leading logistics partners who handle your order efficiently, ensuring a smooth and hassle-free delivery process. Our goal is to make every reasonable effort to ensure that your ordered products from the BLAK SAND Platform reach you promptly.
    • By using the BLAK SAND Platform or purchasing a product through it, you agree to abide by the terms of this Policy without any modifications. We recommend that you review and understand these terms each time you visit the BLAK SAND Platform. If you do not agree with the terms outlined in this Policy, please refrain from using, accessing, or making transactions on the BLAK SAND Platform.
  2. TERMS OF SHIPPING, DELIVERY AND EXCHANGE
    • We collaborate with third-party logistics service providers ("Logistic Partners") to facilitate the shipping and delivery of products purchased on the BLAK SAND Platform. Once your order has been successfully processed and handed over to the designated Logistic Partner, we will provide you with their details. Our standard dispatch timeline ranges from 3 to 7 business days from the date of purchase. You will also receive an estimated delivery timeline that ranges 7 to 10 business days at the time of placing order. Additionally, we will share order details, including dispatch updates, via the email ID and/or mobile number provided by you or registered with us. While we primarily use Logistic Partners for deliveries, we reserve the right to ship and deliver products directly without engaging any third-party service providers.
    • While we strive to offer shipping and delivery services across India and most countries worldwide, we may, at our sole discretion, designate certain areas as unserviceable. Neither we nor our Logistic Partners will process orders for delivery in such locations. If your area falls under this category, you will be notified at the time of placing your order on the BLAK SAND Platform. To check whether your location is serviceable, you can enter your area’s pin code on the platform before placing an order.
    • To ensure timely and accurate delivery, we may collect details such as your name, shipping address, billing address, landmarks, and contact information. It is your responsibility to provide accurate, complete, and sufficient details for successful delivery. Any failure to do so may result in delivery issues, and you will bear full liability for any failed deliveries caused by incorrect or incomplete information. We shall not be held responsible for any delays or non-deliveries due to inaccurate details provided at the time of order placement.
    • We will make every effort to deliver your order within the estimated timeframe. If you are unavailable to receive the order, our Logistic Partners will make up to three delivery attempts. If all three attempts are unsuccessful due to your unavailability, we reserve the right to cancel the order and return the product to us. In such cases, any refunds processed will be subject to a deduction for shipping and delivery charges incurred by us.
    • While we make every reasonable effort to ensure that purchased products are delivered to you within the estimated timeframe, you acknowledge and accept that delays may occur due to:
      • Logistical challenges beyond our control
      • Unfavourable weather conditions
      • Political disruptions, strikes, or employee lockouts
      • Acts of God, such as floods or earthquakes
      • Other unforeseen circumstances

      In the event of a delay, we are not obligated to provide compensation for any claims arising due to delays in shipment, delivery, or usage of the purchased products.

    • We strive to engage Logistic Partners, employees, and agents who uphold the highest standards of ethics, integrity, and professionalism. However, you acknowledge that we do not have direct control over the actions or behaviour of individual delivery personnel, nor can we monitor every delivery executive.

      As we only facilitate the delivery of products, we shall not be held liable for any acts or omissions by our delivery agents, employees, or Logistic Partners, including but not limited to:

      • Service deficiencies
      • Incorrect deliveries
      • Delays in delivery
      • Tampering with product packaging

      For clarity, any misconduct, impoliteness, or inappropriate behaviour by delivery personnel, whether employed by us or our Logistic Partners, is beyond our control. Should any issue arise between you and a delivery executive, it is your responsibility to resolve the matter independently. You agree not to hold us accountable or expect us to mediate, settle, or intervene in any disputes between you and the delivery personnel.

    • Once you place an order on the Ritu Kumar Platform, we process it and hand over the purchased product to our Logistic Partner. Upon dispatch, you will receive a unique tracking ID, which allows you to monitor the delivery status of your order. You can track your shipment using this ID.

      Our customer service team works closely with our Logistic Partners to ensure timely delivery and makes every reasonable effort to have real-time tracking updates. However, as deliveries are carried out by third-party service providers, we cannot guarantee the accuracy of tracking information. Discrepancies may occur due to time lags in updates or technical issues beyond our control.

    • We reserve the right to impose or adjust shipping fees for products from time to time. Shipping charges may vary based on factors such as product value, type, delivery location, and payment method, as outlined in the table below.

      You agree that we are authorized to collect shipping and delivery fees on behalf of our Logistic Partners for the services they provide. If a shipping fee is applicable to your order, it will not be refunded in the event of a return request. However, we may make exceptions and refund the shipping charges if a defective, damaged, incorrect, or deficient product is delivered, provided the issue is verified and accepted by us at our sole discretion.

      You acknowledge that ownership and risk of the purchased products are transferred to you upon successful delivery.

    • At BLAK SAND, we are pleased to serve customers worldwide, extending our collections beyond borders. To ensure a seamless shopping experience for our international customers, we follow the customs policy outlined below:
      1. Customs Charges:

        The prices displayed on our website do not include any customs duties or charges that may be applicable in your country. These fees are determined by your country’s customs authorities and are not included in the product price or shipping cost.

      2. Customer Notification:

        Once your order is shipped, our courier partner will contact you to inform you of any applicable customs charges. You will receive details about the nature of these charges and the payment process.

      3. Customer Responsibility:

        Any customs duties or charges imposed by your country's authorities are solely the responsibility of the recipient. BLAK SAND has no control over these fees, and customers are required to pay them as per local regulations.

      4. Payment Process:

        Customers must make the necessary customs payments directly to the courier partner handling their delivery. The accepted payment methods will be communicated to you during the notification process.

      5. Support and Assistance:

        If you have any questions or need assistance regarding customs charges or payment, our customer support team is available to help. Feel free to contact us, and we will do our best to assist you promptly.

      6. Delivery Timeline:

        Please be aware that customs clearance procedures may cause delivery delays. While we strive to ensure timely delivery, these delays are beyond our control and vary based on your country’s regulations.

        By placing an international order on blaksand.com, you acknowledge and agree to the terms of this customs policy.

    • As a standard company protocol across all direct point of sales, BLAK SAND does not endorse any return policy irrespective of a domestic or international order, neither on off the rack nor on made to order pieces, we only facilitate exchange in case of the below mentioned exceptional scenarios:
      • If the product you have ordered from us is not received in good condition, is damaged or defective.
      • If the product you have ordered is fitting true to size.

      In all the above scenarios, the client must notify BLAK SAND about the issue through email with the images of the problem within 24 hours of receiving it.

      However, it is only after receiving an acknowledgment of the same from BLAK SAND, you may send the product back to us for the necessary corrective actions. Unsolicited returns will not be received without authorization. Once the product is received by BLAK SAND, please be informed that the sole discretion of accepting the return and/or exchange of the rejected piece lies with BLAK SAND only based on the timelines and quality of the returned piece. While returning the product please ensure that it is unused, and is in a properly sealed condition as you received it, with its original packaging.

    • All Credit Notes issued are for the MRP amount only and do not include any applicable shipping/duties or tax amount.

      No returns or exchanges are allowed on discounted products.

    • Once an order is confirmed, it cannot be cancelled. In the event of a cancellation, the full payment (100%) will be forfeited and treated as the cancellation fee for all cancellations. Kindly take note that our brand's policy does not include the provision of refunds.
